MCASA E-lert: CALL NOW: Ask the House Judiciary Committee to Reject Senate Amendments to SB250

Apr 01st, 2021

Thank you to Delegate Charlotte Crutchfield, Senator Susan Lee and Senator Jeff Waldstreicher for sponsoring the bills to end marriage as a defense to sexual crimes. Now the Judiciary Committee needs to reject troubling Senate amendments and conform the Senate Bill to the House Bill.

The Senate amendments to SB250 mean that if you are part of a couple (married or not), your right to consent and refuse sexual touching is different than if you are not in an intimate relationship. People in intimate relationships would be faced with an extra hurdle after an assault.  This is wrong.  All people should have the right to control their own body and sexuality.

MCASA firmly believes that a person’s right to consent should not depend on whether they are married or whether they are in a relationship. All people should have the same right to control how they are touched and to say no to “intentional touching of the victim’s or actor’s genital, anal, or other intimate area for sexual arousal or gratification, or for the abuse of either party” (quoting Crim.L.§3-301(e)(1)).

Please urge members of the Judiciary Committee to
conform SB250 to the bill they passed: HB147- Repeal of Spousal Defense (Love Is No Defense to Sexual Crimes).
