Maryland's Wiretap Act requires the consent of all individuals involved in order to legally record a communication. Senate Bill 1007/House Bill 314 would create an exception to this law.
There have been cases where rape survivors have recorded the crime, but the recording was inadmissible and could not be considered by the court or jury. There are already exceptions in the law for audio recordings across state lines. Victims of violent crimes deserve support whether their perpetrators are out of state or right here in Maryland.
The current law is a barrier to justice and deprives courts of crucial evidence. This bill would allow courts to decide whether the recording could be used in evidence, even if everyone (including the perpetrator) did not consent to the recording.
Please ask the Senate Judicial Proceedings Committee to support SB1007 and the House Judiciary Committee to support HB314 to protect survivors by allowing audio evidence in court!
