Maryland's Wiretap Act requires the consent of all individuals involved in order to legally record a communication. This means that even when sexual assault survivors bravely record the crime, their recordings may be ruled inadmissible in court. Survivors have lost critical opportunities for justice because judges were not allowed to consider this evidence.
Senate Bill 1007 would fix this by giving judges discretion to admit these recordings into evidence in cases involving crimes like sexual violence.
