U.S Department of Education Resumes Enforcing the 2020 Title IX Rule

The U.S. Department of Education announced last week that they have resumed enforcing the Title IX Rule put into place in 2020. This comes after the U.S. District Court for the Eastern District of Kentucky issued a decision vacating the 2024 Title IX Rule, which prohibited the Department of Education from enforcing it in any jurisdiction

The 2020 Title IX Rule significantly weakened protections for student sexual assault survivors. Among other things, these regulations: 

  • Narrow the definition of sexual harassment under Title IX; 
  • Change the definition of "sex" to male and female
  • Restrict the types of incidents schools are required to investigate; 
  • Make it more difficult for survivors to hold their schools accountable in a court of law; and 
  • Allow for cross-examination of survivors at a live hearing by the accused student's attorney.
