Maryland's Wiretap Act requires the consent of all individuals involved in order to legally record a communication. Senate Bill 1007/House Bill 314 would give judges discretion to admit these recordings into evidence.
Yesterday, the Senate Judicial Proceedings Committee reported favorably on this bill with amendments to limit the bill to cases involving crimes against individuals. This is a reasonable first step and will help survivors of sex crimes.
There have been cases where rape survivors have recorded the crime, but the recording of the sexual assault was inadmissible and could not be considered by the court or jury. This deprives courts of crucial evidence.
Please call now and ask the House Judiciary Committee to vote on SB1007 and HB314 to protect survivors by allowing audio evidence in court!
